We have applied for extension of our non-immigrant status on Dec 20, 2008 and are still waiting for the decision of USCIS. There are following questions in mind:
1. Can we apply for any other non-immigrant status (F1, E2 , H1 etc) during this wait time?
2. What will happen if our request for extension of stay is denied? Can we file a petition against this denial?

Hi Santosh,
I encountered US/ANLUS website while searching some information. It is fine. It brought some of my nostalgia in Law Campus. A lot of people in USA and very good thing is that they doing practice. We need to establish our credibility. I am doing a project at Kathmandu School of Law now on looking possibility of evolving a system of law that might help our economic transformation future. China in the north with trade potential operates with Civil Law system and India in the south with big trade with Nepal the common law system. Should we stick on one system of law if we look our prospect a reality in future. It would be a great service for nation if some of you can think of doing research and suggest what the nation should do in this regard. If you allow me I can post a ‘introductory’ article to escalate debate.
sincerely yours
Yubaraj

Dear Yuvaraj Sir
Thank you for your insight. Please feel free to initiate the topic as it is definitely an important agenda. Please email us the introductory theme and we shall take it further. I also think that we should initiate the topic as a seperate page itself, given its significance.

During my five years research on that topic I knocked every possible doors in Nepal but did not find Nepal government serious to support me in this regard. I did not imagine Yaubaraj Sir could have thought of it since my impression was that he is more focused on human rights issues. During my stint in FNCCI, I have seen this topic from both grassroots and policy level. Let’s do something concrete on this.

Dear sir,
I filed my H1B from one of the indian consultancy.
But the thing is , the case is still on pending.
My OPT will end in Dec 15 and i have one month grace period left i.e. til Jan 15.
I wanted to know that will i be in status till the case is in pending or do i have to change my status before Jan 15 to be in status.
if i will be in status till case is pending then if my H1 gets rejected will i get any grace period to come back to status if yes for what duration.
I would sincerely appreciate your help.
thanking you,
Abhishek

I am an international graduate student on F-1 visa. I was in a domestic violence situation with my husband who is a post-doc at the same university. He has been extremely abusive – verbally, emotinally and physically. As it is not safe for me to work in the same lab, and my student visa would be in a problem and I need to work for financial support, I would like to go for U-visa. Can any immigration lawyer give me more information on this U- visa and whether I am eligible for it. I am at presnt in India and will come back accordingly.
As for legal proceedings, police came to my home and put a temporary restraining order on my husband.
