New York Bar Exam is scheduled for February 23-24, 2010. The application fee for the New York State bar examination is $250. Application deadline is November 30, 2009. Nepali Lawyers may qualify as Attorney applicants. Contact State Bar of New York for details. While the Board does not set a specific date for the release of bar exam results, historically results from the July examination are released in mid-November, and the results of the February examination are released in mid-May. Is Nepal entering another bloodbath? – By-Mani Nepali and Rudra Sharma
After a recess in violence due to the match matching of the Seven Parties Alliance (SPA) and the Communist Party of Nepal (Maoist), Parties to Nepal’s decades long conflict are seem to be posed for head on collision once again. After the election of the president ending the constitutionally mandated politics of consensus, the SPA especially Nepali Congress and Maoist are two poles apart. The Prime Minister himself has warned that there would be another but bigger ‘people’s rebellion’ if he is put out of power anyway and the defense Minster who has not yet intermingled with the army warns to take action against the top brass amidst the rumors that the government would replace the Chief of Army Staff (CoAS) by a Maoist leader. These warnings of the Prime Minister and the defense minster demonstrate that the Maoist is all ready to exert punches and blows to each and every obstacles in their way to capture absolute power to the Maoist communism. On the other hand, democratic forces have already started their exercises to deter, defer and defuse the Maoist attempts to capture absolute power. The exercises of making greater democratic alliance and sporadic remarks of some of the leaders are the testimony o f the same. International community would also not be happy with the Maoist attempt to capture absolute power. Congress leader Sushil Koirla already warned that there would be ‘civil war’ if the government tries to replace the CoAS out of no reasons. Similar comments and remarks have come from other leaders of democratic side. Such a situation in Nepal makes it clear that anything may happen in Nepal at anytime and the Nepalis all over the world as well as the friends of Nepali people should be in red-red alert to save Nepal if anything happens there.
Thus, there are mounting speculations that Nepal is awaiting for another bloodshed since Nepal could not buy peace even by giving the power including the post of Prime Minister to the rebels-turned rulers, the Communist Party of Nepal (Maoist). As the saying goes, “You can buy pillow but not sleep,” Nepal could buy only a beautiful and expensive pillows in the form of stacks of peace agreements but not peace as the whole nation is still put into ransom by and between the Maoist red-armies in cantonments waiting their way to Nepal’s national army and the Maoist’s Young Communist League (YCL) all over the country from the nook and cronies of villages to the table of the Prime Minister.
A faction of Maoist hardliners led by Mohan Vaidya ‘Kiran’ supports the YCL activities and the Maoist led government is almost failed to bring criminal activities of the YCL to justice. The Maoist Prime Minister Puspa Kamal Dahal “Prachanda” surrenders to the hardliners within his party and makes himself ready to punch the final assault for totalitarian set up of the government and simultaneously he cools down democratic forces as if he is a democrat. While visiting China, Prachanda was more communist then Chinese themselves and while visiting the US, he tired to be more democrat than American themselves. Such instability and unpredictability in the Prime Minister and Maoist leaders themselves have posed Nepal into the threshold of another series of conflict and bloodbath.
Therefore, the situation of Nepal at the moment is like an interval after a deadly storm and waiting for a much deadlier one in the near future. After killing over 30, 000 (officially about half of it) sons and daughters of Nepal, the Maoists really came to a cease fire because of the immense internal and international pressure. They have promised the Nepali people that they would really stop the bloodbath and sincerely follow the peace process. Unfortunately the Maoists have demonstrated the notion that they do not really care about the peace process and use this transitional phase to consolidate power for the final assault in order to establish their “People’s Republic” a euphemism for totalitarian communist rule.
The Maoist committed themselves to a competitive multiparty political system, periodic elections, fundamental rights, press freedom and the rule of law in all formal documents since they entered the peace process. They have publicly said many times that they have accepted federal democratic republic, bourgeois democracy and so on. Their election manifesto says the same. Unfortunately what they have said are not justified with their verbal and written expressions and their activities since they managed to come into power.
An official resolution passed by the recent Maoist conclave in Kharipati is the testimony that proves Maoists’ true intention to use/misuse this transitional phase as a ploy to maneuver to totalitarian communist rule. Some key excerpts of the Kharipati conclave are as follows –
• Of the three stages of the Maoist People’s War, the Maoist revolution in Nepal has currently reached the stage of strategic offence with its own indigenous characteristics.
• The PLA’s main role is to serve as a force to complete the revolution and prevent counter revolution. It has to prove itself as a force of creativity, firmness, offence, dynamism and invincibility.
• Prepare the PLA politically and ideologically for the offensive to complete the revolution.
• The PLA will undergo ideological and political training on Prachandapath and MLM (Marxism, Leninism and Maoism). The training will be at basic, intermediate and advanced levels.
• There will be regular interactive meetings with the party committee in the army.
• The integration of the PLA will be used in a manner that will further cause of proletarians and revolution. The issue of army integration should be used in this context.
The above accounts prove whatever the Maoists are doing is a preparation of their People’s Liberation Army (PLA) to capture absolute power and they are doing everything for the same. The Maoists are doing the following for this purpose.
A. Anyone who wants to capture absolute power in twenty-first century would first capture the media. A parliamentarian of Sweden had once said that if Karl Marx was alive today he would probably have written about ‘information’ instead of Das Capital. Thus, Maoist have well-understood the value and importance of media in their venture to capture the absolute power. Recently, the government of Nepal has received a fat cane as a Christmas gift from the press workers protesting the condemnable attack on Himal Press House. They have threatened Kantipur that it’s their turn to be stoned. Recently murdered radio journalist Uma Singh, 26, had accused five Maoists of abducting her father and elder brother in 2006, National Human Rights Commission (NHRC) records show. The whereabouts of the duo are still behind the curtails.
B. Maoists have already failed the civilian government in Nepal except for the capital Kathmandu and some major townships. There is no presence of government and governance in Nepal’s villages and urban areas as the YCL of the Maoist virtually rules the nation’s most of the areas. Given the prevalent impunity in Nepal, it seems that terrorism has become legal in Nepal now through Maoist’s YCL. Further, Nepal’s situation has become further chaotic as Nepal’s another Communist Party United Marxist and Leninist has countered YCL by establishing its Youth Force.
C. Maoist have recently expended their organization base in the bureaucracy and government employees through their tricks and assurances. They hold the civil servants as an important weapons to sustain their power.
D. Maoists still have their red-armies in the cantonment and they would be available for them during the final assault to capture absolute power.
E. On top of this all, Maoists are mulling to obtain international rapport to procure international support during the time of final assault to capture absolute power. The visit of Defense Minster Rama Bahadur Thapa Badal to China is the testimony of the same.
However, this is not the end of the story. This preparation of Maoist for final assault and absolute power is closely watched by Nepali Congress, other democratic forces and international community. Besides, India is also not happy with increasing Maoist hobnob with China. Recent call of Congress President Girija Prasad Koirala for ‘democratic alliance’ is the testimony of the same. This should be understood in the context that Prime Minister Pushpa Kamal Dahal has sought for a new political polarization for the needed revolutionary changes in the country. He has boldly warned for a revolt and indicated another yet a bigger and deadlier bloodbath in the birth place of Buddha, the Messenger of Peace. Heaven save Nepal from such a tragedy.
Therefore, it is high time for the Nepali people and international community to bring the Maoists in the right track so that they do not betray the peace process.
